The trust documents repeat your legal name dozens of times, so it must be exact: the name on your government ID, no nicknames or shortened forms.

Section 3 · People you trust

Who steps in when you can't act?

Four jobs need real names. The successor trustee runs the trust after you; the agent handles finances under the power of attorney; the personal representative guides your will through probate; the healthcare agent makes medical decisions. The same person can hold several jobs — most couples name each other for everything. Each document names a backup too.

Section 4 · Trust terms

Name the trust and list its people

These entries appear on every document — they're how banks and title companies will identify your trust.

Trust name *

Keep it simple: "the Smith Family Trust" or "the Smith 2026 Revocable Trust." You'll use this exact name on every account you move into the trust.

Who benefits from the trust? *

Plain language is fine — "my spouse, then my descendants" works. The trust agreement's Article VI locks in the full rules your attorney review confirms.

Trust protector (optional)

A person with narrow oversight powers — replacing a trustee, fixing name errors. Optional; leave blank and the section stays out of your package.

Your county *

Used on notary Blocks. Your county clerk's office is a reliable place to notarize — many banks do it free for customers.

Section 5 · Property

What will go into the trust?

List the major assets you plan to move into the trust. You don't need exact values, and you can add or edit this list any time in the client portal — funding is an ongoing process, not a one-day event.

Section 6 · Choices

Three document choices

Power of attorney — when does it start? *

Immediately. Your agent can act right away, without proof of incapacity. Simpler — banks accept it on sight. The standard choice.Springing. Starts only when a doctor certifies you can't manage your affairs. Your packet then includes a physician's certification form. Some states are restrictive about these — your prepared documents note your state's rules.

HIPAA — who can receive your medical information?

Prefilled with your agents so your documents work together. You can replace either name.

I want my agent to be able to make gifts on my behalf (gift rider).

Most people leave this off — it's the highest-risk power to delegate. If checked, your package is flagged for attorney review of the gift language first.
